The following information outlines the MyGivingCircle privacy policy. By using and interacting with our site you agree to the terms of this Privacy Policy. As part of our ability to provide our services we collect, use and, in certain cases, disclose information about you to third parties. This Privacy Policy governs the information we collect about you and your use of information we provide to you. By accepting this Privacy Policy you expressly consent to our use and disclosure of your personal information in the manner prescribed in this Privacy Policy. This privacy policy conforms with the Privacy Act 1988 and the Spam Act 2003.

Collection of information
The main ways we collect Personal Information about you are:
- when you submit information, create an account or log-in to MyGivingCircle and/or add or amend your profile information
- when you or a 3rd party post information about or relating to you on the site
- when you vote, join a Giving Circle and/or make a Donation via PayPal, Stripe or our other payment providers as we may use from time to time, in which instance we receive details about your donation excluding credit card details; and
- when you use our site, in which case our system automatically collects information relating to your visit such as your IP address.
You consent (and must procure that any relevant third party consents) to the use of any Personal Information collected in relation to you in accordance with this Privacy Policy.
In addition to the information that MyGivingCircle collects, PayPal, Stripe or our other payment providers we may use from time to time may collect Personal Information from you for the purposes of processing your recurring or one-off Payment. For more detailed information about how your Personal Information is collected, held, used and disclosed, you should consult the website and/or privacy policy of the relevant payment provider
Third party consent
In addition, we may collect your Personal Information when you have given your consent to another party who holds Personal Information about you to allow us access to that Personal Information.
The type of information that we collect from you may include the following: your name, phone number, address, e-mail address, company, biography, IP address, or information stored or provided by cookies.
If you provide a mobile phone number, we may collect and store your SMS communication preferences and consent status.
Why we collect, use and disclose your Personal Information
Our purpose in collecting information about you is to:
- provide you with a better service experience with content that is more relevant to your interests; and
- create an information database and associated content for use as part of mission of helping charities with their fundraising goals
- comply with (or because we are permitted) any relevant laws (including relevant privacy laws);
- we believe it necessary or appropriate in relation to providing you with a service which you have requested;
- to protect the rights, property or personal safety of another MyGivingCircle website user, any member of the public or employee or contractor; or
- To match you with Charities that we believe you may wish to support based on information you provide us
We will not use or disclose any information about you without your consent, unless:
In the absence of such consent we would not be able to provide the product or service you have requested or;
Where required by law we will rely only on explicit consent. In other cases we rely on legitimate interests or performance of a contract.
Legal basis for processing
We process personal information under one or more of the following lawful bases:
• Performance of a contract – to provide the platform and services you request (such as voting, donations and account functionality)
• Legitimate interests – to operate, secure and improve the platform and facilitate charity engagement
• Consent – for promotional communications and data sharing where required by applicable law
• Legal obligations – including record keeping, fraud prevention and regulatory compliance
Disclosing information
In order to operate the Website and provide associated services, MyGivingCircle may share your Personal Information with its related entities, service providers, advisers, Charities and Not-for-profits, grants sponsors and other entities with whom we have a relationship, in the course of operating the Website. Except as set out in this Privacy Policy, we will not otherwise disclose your Personal Information to other companies without your explicit consent.
Users of our site explicitly acknowledge and agree that:
- when they vote, join, or make a Donation, MyGivingCircle may disclose their name, contact details and Donation amount (if applicable) to any Charities that the user has identified as one of their favourite charities, who may use that information for future donor communication, unless and until consent for such form of communication is withdrawn. You can find further information regarding this under the heading ‘Will I be contacted by any Charities or Grants Sponsors?’ Where required by applicable law (including the United Kingdom, European Economic Area and Canada), charities and grant sponsors will only receive your contact details for marketing or supporter communications where you have provided consent. In other jurisdictions, charities may receive your contact details based on our legitimate interest in facilitating supporter relationships, and you may opt out at any time.
- when they vote in a Giving Circle or on the site, MyGivingCircle may disclose their name, email address and postcode to the sponsor of the relevant grant who may use that information for future communication, unless and until consent for such for of communication is withdrawn. You can find further information regarding this under the heading ‘Will I be contacted by any Charities or Grants Sponsors?
- if a members Donation is unsuccessful at any time during the donation period (for example because your chosen method of payment fails), the organisation delivering the good cause may contact the member regarding the failed payment
- if a member is making a donation to an organisation that holds DGR status that their details will be provided to that organisation for the purpose of proving receipts for tax deductible purposes
Communication with you
In order to maximise the utility of our site and associated services we may use your Personal Information to send you service communications via email, telephone or post. Promotional communications are only sent where permitted by law or where consent has been provided. You may withdraw your consent from each of these types of communication channel (and/or from all communication channels) at any time by using the unsubscribe functionality when available (e.g. on email communications) or by contacting us at privacy@mygivingcircle.org
Based on your profile we may from time to time provide your information to charities who we believe you may be interested in donating to and they may contact you directly. You may withdraw your consent from each of these types of communication channel (and/or from all communication channels) by making contact directly with the charity in question, or by contacting us at privacy@mygivingcircle.org. If you are receiving promotional information from another party and do not wish to continue receiving this information, you should contact that other party to ask to be removed from their mailing list.
Communications and marketing (UK & European Economic Area users)
For users located in the United Kingdom and European Economic Area, MyGivingCircle sends promotional or supporter communications only where you have provided explicit consent.
Transactional communications (such as vote confirmations, donation receipts, password resets or service notices) are sent as necessary to operate the service you requested and do not require marketing consent.
SMS Communications
If you provide permission, MyGivingCircle may send SMS messages relating to campaigns, voting reminders, grant announcements and opportunities to support charities.
We do not send marketing SMS messages without consent.
Message frequency varies depending on user activity and major events. Message and data rates may apply depending on your carrier.
You can withdraw consent at any time by replying STOP to any message or by contacting privacy@mygivingcircle.org. Opting out of SMS does not affect essential service emails.
We record the date, time and method of SMS consent for compliance purposes.
Access to the information we hold
You can request access to the Personal Information we hold about you by making a request via privacy@mygivingcircle.org and we will provide you with access unless we are legally authorised not to do so.
Your Privacy Rights
Depending on your jurisdiction you may have the right to:

Data Retention
We retain personal information only for as long as necessary to provide our services, comply with legal obligations, resolve disputes and enforce agreements.
Account data is retained while your account remains active.
Marketing consent records are retained for compliance purposes even if you unsubscribe.
You may request deletion at any time subject to legal retention requirements.
Changing and deleting the information we have about you
If at any time you wish to change Personal Information that is inaccurate or out of date or to have your Personal Information deleted, please contact us by e-mailing us at privacy@mygivingcircle.org
We will take all reasonable steps to change or delete information in response to such a request. If there is a reason that we cannot make that change or deletion, we will inform you of that reason.
Storage and security of your Personal Information
We will endeavour at all times to take all reasonable steps to keep secure any information which we hold about you, and to keep this information accurate and up to date. You should be aware however that the internet is not a secure method of transmitting information and, as such, we are not responsible for the security of any information sent or received over the internet.
Please note that MyGivingCircle may use overseas facilities including but not limited to the US and Europe to store, process or back up its information. Where personal data is transferred outside your country (including to the United States or European Union), we implement appropriate safeguards such as Standard Contractual Clauses or equivalent legal mechanisms to protect your data.. However, this does not change our commitment to keep your information secure.
Mobile opt-in data will not be shared with third parties
Third party websites
The MyGivingCircle.org website contain links to other sites not operated by us. These linked sites are not under the control of MyGivingCircle, and we are not responsible for the conduct of those organisations. Before disclosing your Personal Information on any other website or to any other organisation, we advise you to examine the Terms and Conditions / Privacy Policy of the relevant organisation.
Future changes
From time to time, our policies, including our Privacy Policy will be reviewed and may be revised. We reserve the right to change our Privacy Policy at any time and notify you by posting an updated version on our website. The amended Privacy Policy will apply between us whether or not we have given you specific notice of any change.
Will I be contacted by any Charities or Grants Sponsors?
When you vote or donate to a Charity they may wish to contact you to thank-you for your support and keep you up-to-date with the work they’re doing. When it occurs, contact will usually be via email, and in some instances telephone. When a Charity wishes to contact a supporter we have strict guidelines in place that include:
- Only Charities that you have voted for, donated to, or indicated as one of your favourites can make contact. We do not share your details with any Charity you have not indicated as one of your favourites.
- If making contact by email there must be a clear and easy way for your to unsubscribe from future emails
- They must be courteous, professional and polite. We hope you’ll be interested in hearing from them, but if you’re not, no further contact is made
- They must abide by the Fundraising Institute of Australia’s guidelines – or equivalent body in their own country – regarding contacting you, which can be found here
If you believe any Charity is not abiding by these guidelines we want to hear from you and you can send an email with the details to privacy@mygivingcircle.org
When you vote in a Giving Circle that is sponsored by a 3rd party company, the grants sponsor may wish to contact you for voting, let you know which charities received the grants and/or introduce themselves and their product(s) to you. By voting you are giving express consent to be contacted by the grants sponsor on the basis that:
- contact can only be once only unless you request further information
- you will always have the option to opt-put from any further communications from the sponsor
- They must be courteous, professional and polite. We hope you’ll be interested in hearing from them, but if you’re not, no further contact is made
